1. Granting of Consent:

1.1 By entering into the agreement, the Data Subject hereby grants consent to the business company:

as the Data Controller to process their personal data under the conditions specified below.

1.2 The Company ensures the protection of your personal data in accordance with applicable and effective legislation, which since May 25, 5. 2018 is primarily represented by Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “Regulation”).

1.3 The Company operates the website at the address specified in the header (hereinafter referred to as the “Portal”), through which it provides its goods. These Principles apply to all personal data processed by the Company based on the fulfillment of contractual relationships, legal obligations, legitimate interests, or granted consent, through the Company’s Portal. The Principles describe how the Company uses and protects personal data.

1.4 The Company may modify and supplement these Principles at any time by posting a revised version on the Portal, and such modification and supplement shall become effective on the date of such posting.

1.5 The Data Controller within the meaning of Article 4(7) of the Regulation is the business company named above in the header.

1.6 Consent to the processing of personal data in the full scope under this article is not a condition that would in itself prevent the conclusion of the contract.

1.7 Personal data will be processed electronically by automated means or in printed form by non-automated means.

1.8 The Customer confirms that the provided personal data is accurate and that they have been informed that this is a voluntary provision of personal data.

1.9 When using the Portal, even without registration, the Company will record your IP address and standard information such as your browser type and the pages you viewed on the Portal. This information is used for monitoring and fraud prevention, problem diagnostics, and processing of statistical data that is anonymous and does not include your personal data.


2. Personal data to be processed:

3. The purpose of personal data processing is:

3.1 Sale of goods in the e-shop at the web address specified in the header
3.2 Sending commercial communications to the Buyer from the Seller
3.3 Discount bonus program for Buyers
3.4 Registration in the Seller’s e-shop
3.5 Pre-contractual negotiations
3.6 User account management
3.7 Response to inquiries in the e-shop’s inquiry form
3.8 Providing customized advertisements, sponsored content, and sending promotional information to Data Subjects
3.9 Market, customer, product, and service evaluation and analysis (including requests for opinions on the Seller’s products and e-shop)
3.10 Organization of prize competitions or promotional events


4. Processing of personal data for contract fulfillment

4.1 In case of registration of the Data Subject as a customer, personal data is processed in accordance with Article 6(1)(b) of the Regulation – the provision of personal data is a necessary requirement for the fulfillment of the contract or for the implementation of measures taken before concluding the contract at the request of the data subject. Without the provision of personal data, it is not possible to conduct pre-contractual negotiations, conclude the contract, or fulfill it by the company.


5. Personal data may be provided to the following third parties:

5.1 Personal data processing is carried out by the Controller, however, the following processors may process personal data for the Controller:
a) suppliers, consultants, carriers, and other service providers who participate in the sale and delivery of goods, handling complaints, and processing payments
b) affiliated companies – companies owned or controlled by the company
c) business partners – trusted companies that may provide information about products and services where the Data Subject has provided separate consent
d) law enforcement – when requested by state authorities or for customer protection

5.2 Potentially other providers of processing software, services, and applications, which are not currently used by the Controller.
5.3 The Buyer acknowledges that their personal data disclosed to the Seller for marketing purposes is provided to the Seller voluntarily. Consent to the processing of personal data granted to the Seller for marketing purposes is valid for 7 years, but no longer than until revocation by the Buyer.
5.4 The Buyer can easily unsubscribe from commercial communications by clicking the Unsubscribe link in the email containing the commercial communication or by using the contact form or contacting the Seller through the information line.
5.5 During the complaint procedure, the following data is required from customers: name, surname, address, telephone number, e-mail, and signature or biometric signature. All personal data obtained in this way is processed exclusively for the purpose necessary for handling the complaint.
5.6 The Seller may also collect data when using the e-shop through cookies in accordance with the provisions of Directive 95/46/EC on the purpose of “cookies” or similar tools, and it is ensured that users are aware of the information stored in the terminal equipment they use. Users have the option to refuse cookies or similar tools being stored in their terminal equipment, for example by launching anonymous browsing functionality in their browser.


6. Recording of telephone calls

6.1 With the prior explicit consent of the Subject, the Processor may record telephone calls and process recordings of telephone calls on the customer service line, particularly for the purpose of negotiating contract conclusion, proposals for contractual changes, supplementary information to ensure contract fulfillment, service improvement, handling complaints, etc. The Subject expresses consent to the recording and processing of telephone calls by continuing the call after the operator announces that their call will be recorded. If the subject does not wish to be recorded, they should hang up after the announcement that their call will be recorded and use another communication channel.

6.2 The Company is not responsible for the misuse of provided data that occurred due to unauthorized access by a third party or during data transmission within communication networks. The user acknowledges that data and information provided on the internet, for example in discussion forums, chat, or email, may be misused by third parties.

6.3 The Seller reserves the right to use anonymized data about user activity in web applications to improve its services.


7. Cookies and internet beacons

7.1 So-called cookies (session ID cookies and permanent cookies) are used to store and occasionally track visits to the seller’s website. A cookie is a small text file stored on the Data Subject’s computer for recording purposes. The Seller uses cookies to facilitate navigation on its website. After the Data Subject closes their browser, the session ID cookie expires. Permanent cookies remain on the Data Subject’s hard drive for a longer period. The Seller also stores screen resolution and checks if JavaScript is enabled in the browser to facilitate browsing the seller’s website. Most internet browsers are set to automatically accept cookies.

7.2 The Seller uses two categories of cookies:
a) Functional: These cookies are required for basic site functionality and are therefore always enabled; these include cookies that allow the Data Subject to be remembered during a single visit while browsing the website. These cookies also help with security and fulfilling legal requirements.
b) Social media and advertising: Social media cookies offer the possibility to connect the Data Subject with social networks and share content from the Seller’s website on them. Advertising cookies (third-party cookies) collect information to help better customize advertising, both on the Seller’s website and beyond. In some cases, these cookies involve the processing of the Data Subject’s personal data. Refusing these cookies may result in seeing advertising that is less relevant to you, or the inability to effectively link with Facebook, Twitter, or other social networks, and/or prevent you from sharing content on social media.

7.3 Cookies can be deleted or rejected according to the instructions in your internet browser’s support file. If cookies are removed, access to all aspects of the seller’s portal may be limited.

7.4 The Seller may also collect data when using the e-shop through internet beacons. These beacons are electronic images that can be used on the seller’s portal in connection with the sale of goods or in emails sent by the seller. The seller uses beacons to transmit cookies, count visits, and to inform the customer whether an email has been opened and processed. The seller may also collect information about the buyer’s computer or other access device to mitigate risks and prevent fraud.


8. Recording of telephone calls

8.1 With the prior explicit consent of the Subject, the Processor may record telephone calls and process recordings of telephone calls on the customer service line, particularly for the purpose of negotiating contract conclusion, proposals for contractual changes, supplementary information to ensure contract fulfillment, service improvement, handling complaints, etc. The Subject expresses consent to the recording and processing of telephone calls by continuing the call after the operator announces that their call will be recorded. If the subject does not wish to be recorded, they should hang up after the announcement that their call will be recorded and use another communication channel.


9. Instructions

9.1 The Data Subject declares that they have been properly instructed by the Controller about the processing and protection of personal data, that the above personal data is accurate and true, and is provided to the Controller voluntarily.
9.2 The Data Subject expressly consents to the stated processing.
9.3 Consent can be withdrawn at any time, for example by sending an email or letter to the company’s contact details.
9.4 The Seller implements all appropriate physical and technical measures to secure information collected in connection with the sale of goods in its e-shop.
9.5 The Controller hereby, in accordance with Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, the General Data Protection Regulation (hereinafter referred to as the “Regulation”), informs that:

  1. the Data Subject’s personal data will be processed based on their free consent, under the above-mentioned conditions,

  2. the reason for providing the Data Subject’s personal data is, in addition to the above, the Data Subject’s interest in receiving commercial offers from the Controller, which would not be possible without providing this data

  3. automated decision-making or profiling will not occur during the processing of the Data Subject’s personal data

  4. the Controller has not appointed a Data Protection Officer, nor designated a representative for fulfilling obligations under the Regulation

  5. the Controller does not intend to transfer the Data Subject’s personal data to a third country, international organization, or third parties other than those mentioned above,

  6. The Data Subject has the right (e.g., in their profile administration after login, by email, or by postal mail):
    a) right of access to their personal data (i.e., the right to obtain information whether your data is being processed, and if so, you have the right to access it);
    b) right to rectification of personal data (i.e., to request correction if you find that the company is processing inaccurate or false data);
    c) right to request explanation (i.e., if you suspect that the processing of personal data violates the protection of your personal and private life or processing is being carried out contrary to legal regulations);
    d) right to restriction of processing of personal data (i.e., the right to request temporary restriction of processing of your personal data);
    e) right to erasure of personal data (i.e., in cases where your data is no longer needed for the purposes for which it was processed);
    f) right to object to the processing of personal data (the company is obliged to prove that there is a serious legitimate reason for processing personal data that outweighs your interests or rights and freedoms);
    g) right to data portability (i.e., the right to request that your data be received by a third party);
    h) right to withdraw consent to the processing of your personal data at any time;
    i) right to file a complaint with the Office for Personal Data Protection (i.e., if you believe that your right to personal data protection has been violated).
